By accessing, registering for, or using MailScan AI (the "Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Refund Policy, all of which are incorporated herein by reference.

If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and these Terms apply to both you and the organisation.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any updates to these Terms constitutes acceptance of those changes.

MailScan AI reserves the right to modify these Terms at any time. We will notify users of material changes via email with at least 14 days' notice prior to changes taking effect.

To access the full Service, you must create an account. By registering, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security of your password and accept all risks of unauthorised account access.
• Immediately notify us at support@mailscan.ai of any unauthorised use of your account.
• Be solely responsible for all activity that occurs under your account.

You must be at least 16 years old to create an account. By registering, you confirm you meet this age requirement. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

Each person may maintain only one free account. Creating multiple accounts to circumvent credit limitations is a violation of these Terms and may result in account termination.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all content you submit for analysis.

You must not:

• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
• Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or proprietary technology.
• Submit content that you do not have the legal right to process, including emails containing third-party confidential information without authorisation.
• Use automated scripts, bots, or scrapers to interact with the Service beyond normal use without prior written consent.
• Attempt to circumvent rate limits, credit systems, or access controls.
• Engage in any activity that could damage, disable, or impair the Service or servers or networks connected to the Service.
• Create multiple accounts to obtain free credits fraudulently.
• Resell, sublicense, or commercially exploit the Service without our express written permission.

Violation of this policy may result in immediate account suspension or termination without refund, and may be referred to appropriate law enforcement authorities where required.

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

Key data processing commitments:

• Email content submitted for analysis is processed ephemerally and permanently deleted after your result is generated.
• We do not sell, rent, or monetise your personal data.
• We do not use your submitted email content to train, fine-tune, or improve AI models.
• All data is processed in compliance with applicable data protection laws including GDPR.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

No Security Guarantee

MailScan AI is a threat analysis tool designed to assist decision-making. It is not a substitute for comprehensive cybersecurity measures. MailScan AI does not guarantee that all threats will be detected, and we accept no liability for damages arising from reliance on analysis results, including undetected threats or false positives.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MailScan AI AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MailScan AI IN THE SIX MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Termination by You

You may terminate your account at any time by contacting us at support@mailscan.ai or through your account settings. Upon termination, your account data will be deleted within 90 days. Unused credits are non-refundable upon voluntary account termination unless otherwise required by applicable law.

Termination by Us

We reserve the right to suspend or permanently terminate your account at our discretion, with or without notice, if we determine that you have:

• Violated these Terms or any applicable law.
• Engaged in fraudulent activity or abuse of the platform.
• Caused harm or risk to other users or our infrastructure.
• Failed to pay for services rendered.

In the event of termination for cause, unused credits may be forfeited without refund. We will provide notice where reasonably practicable, unless immediate termination is required to prevent ongoing harm.

Effect of Termination

Upon account termination, all rights granted under these Terms immediately cease. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

We may revise these Terms of Service at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify all registered users via email at least 14 days before changes take effect.
• Display a prominent in-app notification.

Material changes include modifications to your rights, payment obligations, data handling, or limitation of liability. Minor clarifications or formatting changes may be made without separate notification. We encourage you to review these Terms periodically.
